Is CBD flower legal in UK?

In short, no it’s 100% illegal to have CBD flower in the UK. This also includes hash, weed and buds. The UK treats all forms of cannabis flower products as B class drugs. This means you could potentially face jail time and/or receive a fine if found in possession of it. Unlike the USA, the UK government can choose to fine you unlimited amounts. You must therefore take care and consider if the CBD product you’re purchasing is completely legal within UK law.

Furthermore, products that are derived from industrial hemp(such as CBD edibles) must contain less than 0.2% of THC with the exception of CBD flower which is illegal regardless on the percentage of THC.

From all the information we have found online, CBD flower has always been illegal in the UK.  For a while, CBD flower and bud were a grey-area in UK law as many authorities did not know where they stood on enforcing CBD bud and flower products. In 2020, the law is clear on CBD flower and the government take it very seriously.

Why is CBD flower illegal in UK?

There is a lot of confusion amongst the UK as many don’t understand how a CBD product below 0.2% THC can still be illegal. We understand for the police force in the UK it’s difficult to differentiate CBD flower with THC Flower above the 0.2% THC limit.  As per the cultivation of hemp license (which must be obtained to grow hemp legally in the UK) hemp seeds and fibre can only be sold for commercial purposes.
